Convicted felon dad guilty of beating 3-year-old son (Luzerne County, Pennsylvania)

Holy crap. Dad DAVID CAPPS JR. is certainly a winner. I'm not going to even attempt to describe the sheer variety of Daddy's criminal activities. All I can say is that I'm certainly not surprised that among Daddy's many accomplishments, he also managed to brutally beat his 3-year-old son.

Convicted felon guilty of beating 3-year-old son

A convicted felon who moved to Luzerne County from Virginia while on parole for threatening to blow up a building was convicted Wednesday of severely beating his 3-year-old son last fall.

Jurors convicted David Capps Jr., 39, of Salem Township, of endangering the welfare of a child, a third-degree felony, and misdemeanor simple assault but found him not guilty of recklessly endangering another person.

Capps, a father of six, faces up to 12 years in prison and a combined $25,000 in fines. Senior Judge Kenneth Brown said he would recommend a sentencing hearing sometime in early January. Brown ordered Capps, who had been free on $5,000 unsecured bail throughout the trial held at the Luzerne County Correctional Facility in lieu of $15,000 bail.

Capps has a "lengthy criminal history," according to Luzerne County Assistant District Attorney Jenny Roberts, including driving while intoxicated, myriad terroristic threats and a January 2004 conviction for threatening to bomb a building in Newport News, Va.

According to Luzerne County prosecutors, Capps beat his son so severely he caused injuries to the boy's chest, neck, arms and shoulders, requiring hospitalization and affecting his ability to breath.
